Los delitos de lesa humanidad

Abstract

Concepto de delitos de lesa humanidad. ¿Porqué surgieron los delitos de lesa humanidad?. ¿Cuándo surgieron los delitos de lesa humanidad?. Condiciones o características de los delitos de lesa humanidad. Modalidades o figuras de los crímenes de lesa humanidad. Aspectos generales a todos los delitos. Conclusiones La respuesta debe elaborarse necesariamente en el marco del derecho penal internacional y derecho humanitario, que a través del tiempo fueron creando normas, que prohibían ciertas conductas, y de esa manera pretendieron proteger los bienes jurídicos de mayor trascendencia e importancia para el Hombre. El concepto fue evolucionando a través de la historia y ampliándose la nómina de actos prohibidos, llegando a la definición más elaborada en el Estatuto de Roma de la Corte Penal Internacional (ERCPI), que reclama también, la concreción de elementos objetivos y subjetivos para conformar un tipo penal especial, que se hallan comprendidos, como dice el preámbulo del Estatuto de Roma (cuarto párrafo) entre “los crímenes más graves de trascendencia para la comunidad internacional en su conjunto”.
