De la libertad de expresión a la responsabilidad de prensa

Abstract

La libertad de opinión, prensa e información, fue consagrada como un derecho fundamental en la Carta Política de 1991. El ejercicio irracional de esa libertad por parte de los medios de comunicación, que escudándose en el absolutismo de la libertad de opinión, que no tiene obligación correlativa del rectificación que se tiene por mandato constitucional cuando se informa, ha llevado a que surja la propuesta de reformar la constitución con el fin de pasar de la libertad de expresión a la responsabilidad de prensa. Esa propuesta debe analizarse desde diferentes puntos de vista, comenzando por una conceptualización histórica de este derecho en nuestro país, siguiendo con el análisis del enfrentamiento que se da entre esa libertad y otros derechos fundamentales, por ultimo analizar qué tan viable es esta propuesta en el Estado Social de Derecho, cuál sería el procedimiento reformatorio de la Constitución más idóneo para ello y determinar los principales objetivos de la reforma propuesta.
