El estado de cosas inconstitucional análisis de los motivos de la Corte Constitucional para su declaratoria

Abstract

En esta monografía se hace un estudio conceptual del estado de cosas inconstitucional, se define en qué consiste la figura y se rastrean sus orígenes en la jurisprudencia de los Estados Unidos. Adicionalmente se establece una definición del principio de progresividad que ha servido a la Corte Constitucional para crear esta figura y se determina la relevancia de este principio como elemento fundamental para su declaratoria. Como núcleo del desarrollo de este trabajo, se analizó cada uno de los casos en los que la Corte decidió declarar esta figura, además, se hizo una interpretación sobre la coherencia en los motivos. Al final, se interpreta el desarrollo de la línea jurisprudencial en esta materia y se exponen las conclusiones.
