Abstract

I saggi raccolti in questo Volume affrontano, da angoli visuali differenziati ed anche in riferimento a settori disciplinari diversi, un tema ampio e complesso. Per un verso, l’intervento punitivo si mostra, nell’esperienza storica e contemporanea, quale arma ‘a doppio taglio’ il cui impiego, asseritamente legittimato da finalità di tutela di interessi individuali, collettivi e generali, finisce per costituire troppo spesso uno strumento repressivo in rapporto a persone in condizioni di povertà e/o marginalità: un ‘diritto della miseria’. Specularmente, il diritto penale risulta sovente inadeguato proprio in rapporto alla tutela dei bisogni fondamentali delle persone. In particolare, l’illusione repressiva e il mito del carcere come panacea dei mali sociali, confrontati con gli esiti inappaganti cui danno luogo, sia sul piano dell’efficienza che delle garanzie, fanno sì che possa parlarsi di ‘miseria del diritto penale’.
