Abstract

The study on the cultural heritage does a part of a work, Il diritto privato dell’Unione Europea (edited by A. TIZZANO), turned to give organic arrangement in the European Law to the most important issues of Italian private rights. In particular, this article, after framing the iter of formation of the Community Law instruments in order to the protection of the transfer of the cultural goods into the Community, deepens the institute of the “restitution” of the cultural objects illicitly exported from a Member States, contained in the directive 93/7/CEE of the Council and successive modifications. Of the mentioned directive comes defined the application ambit, the procedures for the return of the cultural objects, the internal judge's competence and the determination of the indemnity in favour of the legitimate owner. The article is devoted also to point in evidence the common normative approach in this matter between the Community law and the UNIDROIT 1995 Convention on Stolen or Illegally Exported Cultural Objects. This last one is placed on the plan of the private international right like effective instrument of the protection of the cultural heritage in case of illicit transfer. Complete the investigation some references to the impact of the European law and the mentioned Unidroit Convention on the Italian legal system and specially to the specific rules of Testo Unico sui beni culturali ed ambientali.

Lo studio sui Beni culturali fa parte di un’opera, Il diritto privato dell’unione Europea (a cura di A. Tizzano), volta a dare organica sistemazione all’insieme dei profili di diritto comunitario rilevanti per il diritto privato italiano. In particolare, il saggio dopo aver ricostruito l’iter di formazione degli strumenti normativi comunitari in ordine alla tutela del trasferimento dei beni culturali all’interno della CE, approfondisce l’ istituto della “restituzione” dei beni culturali illecitamente esportati da uno Stato membro, contenuta nella direttiva 93/7/CEE del Consiglio e successive modifiche. Della citata direttiva viene definito l’ambito di applicazione, le procedure per la restituzione dei beni culturali trafugati, la competenza del giudice interno e la determinazione dell’indennizzo a favore del legittimo proprietario. Il saggio mette in evidenza altresì la comunanza di approccio normativo tra il diritto comunitario in subiecta materia e la Convenzione Unidroit del 1995 sui beni culturali rubati o illecitamente esportati. Quest’ultima si pone sul piano del diritto internazionale privato come efficace strumento dei beni in questione nonché del loro lecito trasferimento. Completano l’indagine dell’A. riferimenti all’impatto della normativa comunitaria e della citata Convenzione sull’ordinamento italiano adattatosi ad esse con specifiche norme del T.U. sui beni culturali ed ambientali.
