Abstract

L'emergenza modifica l'ordinamento giuridico. E' un fatto giuridico straordinario, che modifica i poteri, deroga alle leggi ordinarie. Ha un fondamento e un limite: lo stato di necessità e la responsabilità politica. Trasforma i diritti fondamentali, i poteri pubblici e tocca interessi sensibili: chi decide sulla salute in emergenza? Chi ha il potere di chiudere le scuole- la regione o lo Stato ? A questi interrogativi è dedicato il breve articolo che segue.
