The Caspian sea: Political and legal aspects

Abstract

ABSTRACT The collapse of the USSR, together with its economic and political repercussions, has also caused the emergence of the legal status of the Caspian Sea as a major question in the Caspian region. The legal status issue has been on the agenda since the end of the 19th century, when the Sea had two littoral states, Russia and Persia. Under the rule of Russia and Persia the Sea was legally accepted as an 'enclosed sea', but the navigational practice and resource management were conducted as if it was a 'boundary lake'. The legal status problem has become more intricate as the quantity of the neighboring states, thus the clashing interests over the Caspian Sea have increased. The debate over the legal status of the Sea has been so complicated that it is hard to classify and characterize the arguments of the parties of the debate. While a consensus on the division of the Caspian Sea has been reached, there are still many problems concerning the regulations on the Caspian Sea, which need the cooperation and agreement of the littoral states, on both bilateral and multilateral levels. The border dispute among the littoral states of the Caspian Sea is one of the prospective threats to the cooperative atmosphere in the region, especially the one between Azerbaijan and Turkmenistan. ÖZET Sovyetler Birliği' nin çöküşü, pek çok ekonomik ve politik etkisinin yanında Hazar Denizi' nin hukuki statüsünün de ciddi bir problem olarak ortaya çıkmasına sebep oldu. Hazar Denizi 'nin hukuki statüsü 19. yüzyılın sonundan itibaren, o zamanki kıyı devletleri Rusya ve İran'dan müteşekkil iken de gündemdeydi. Rus ve İran idaresi altında, Hazar Denizi hukuki olarak 'kapalı deniz' şeklinde adlandırılıyor, ancak denizcilik ve yer altı kaynaklarının kullanım açısından 'sınır gölü' kuralları uygulanıyordu. Hukuki statü meselesi, kıyı devletlerin sayılarının, dolayısıyla çakışan menfaatlerin artmasıyla birlikte çok daha karmaşık bir hal aldı. Hazar Denizi' nin hukuki statüsü üzerine devam eden tartışma öyle karışık bir hal aldı ki, taraf devletlerin argümanlarını tam tespit edebilmek çok zor hale geldi. Hazar Denizi'nin bölünmesi hususunda genel bir anlaşmaya varılmış olsa bile, halen bütün kıyı devletlerin üzerinde ortak çalışmayla anlaşmaya varmaları gereken düzenlemelerle ilgili problemler mevcuttur. Hazar Denizi üzerindeki sınır tartışmaları, hususen Azerbaycan ve Türkmenistan arasındaki sınır anlaşmazlığı, bölgedeki işbirliği ve uyum havasını zedeleyebilecek tehditlerin başında gelmektedir.
