La presente tesis doctoral estudia el proceso de transformación del principio de legalidad penal en Colombia, a partir de su concepción sustancial. Sobre esta base, el principio analizado se define en razón de las tensiones actuales que se presentan entre el concepto de ley positiva y sus divergencias con respecto a los elementos de justicia material y seguridad jurídica. Todos ellos integrantes de un principio mayor que los contiene en el Estado Social de Derecho relativo al principio de Legitimidad.
This doctoral thesis studies the process of transformation of the principle of criminal legality in Colombia, based on its substantial conception. On this basis, the principle analyzed is defined by the current tensions between the concept of positive law and its divergences from the elements of material justice and legal certainty. All of them are members of a greater principle that contains them in the Social State of Law relative to the principle of Legitimacy.
