Abstract

Este trabajo presenta en sí mismo una reflexión en torno a la aplicación de la moción de censura como mecanismo de control político en Colombia, tema propuesto y ampliamente debatido en la Comisión Tercera de la Asamblea Nacional Constituyente, y como función principalísima ejercida por el poder legis- lativo, que constituye el núcleo mismo del derecho constitucional moderno, esto es, la idea de control político como garantía de la observancia del principio de separación y coordinación de los poderes del Estado como requisito para la existencia de un auténtico régimen constitucional. Se hace un análisis al concepto, procedimiento y efectividad de la moción de censura, en los casos presentados en los periodos presidenciales de César Gaviria, Ernesto Samper, Andrés Pastrana y Álvaro Uribe, estableciendo cómo opera el control político en Colombia y se determina por sus resultados, elementos claves de su efectividad.

This article presents a reflection on the implementation of the censure motion as a mechanism of politicalcontrol in Colombia, proposed and widely discussed in the third committee of the National Assembly, andas a paramount role exercised by the legislature which constitutes the core of modern constitutional law,that is, the idea of political control to guarantee the observance of the separation principle and coordinationof the government branches as a condition for the existence of a genuine constitutional rule. An analysisof the concept, process and effectiveness of the Motion of No Confidence in the cases presented in thepresidencies of Cesar Gaviria, Ernesto Samper, Pastrana and Alvaro Uribe, establishing how political controloperates in Colombia and determining its results, key elements of its effectiveness.
