Análisis de la jurisprudencia constitucional en materia de hacinamiento carcelario: limitaciones y retos de implementación

Abstract

El presente artículo aborda las limitaciones y retos de la implementación de la Jurisprudencia Constitucional en materia de hacinamiento carcelario, por lo que, a través de un estudio cualitativo, documental y con alcance descriptivo, fueron exploradas las sentencias T-153 de 1998, T-388 de 2013, T-762 de 2015 y SU-122 de 2022, paralelo a que se verificó el comportamiento porcentual del hacinamiento entre los años 2013-2023. En este sentido, los resultados arrojaron graves deficiencias en el sistema penitenciario colombiano y han marcado hitos importantes en la protección de los derechos de los reclusos y sus visitas, tales como la prohibición de requisas intrusivas, la obligación de garantizar visitas intimas sin importar orientación sexual, la restricción del uso de celdas de aislamiento de forma indiscriminada y la protección de los derechos sexuales y reproductivos de las mujeres privadas de libertad. A pesar de algunos avances temporales en la reducción del hacinamiento, persisten problemas estructurales profundos que requieren reformas integrales y sostenidas. Las decisiones judiciales subrayan la urgente necesidad de políticas que respeten los derechos humanos y garanticen condiciones dignas dentro de las prisiones, así como una intervención coordinada del Estado para implementar cambios efectivos y duraderos.

This article addressed the risks and challenges of the implementation of Constitutional Jurisprudence regarding prison overcrowding, therefore, through a qualitative, documentary study with a descriptive scope, sentences T-153 of 1998, T- 388 of 2013, T-762 of 2015 and SU-122 of 2022, parallel to which the percentage behavior of overcrowding was verified between the years 2013-2023. In this sense, the results revealed serious deficiencies in the Colombian prison system and have marked important milestones in the protection of the rights of prisoners. Despite some temporary progress in reducing overcrowding, deep structural problems remain that require comprehensive and sustained reforms. The judicial decisions highlight the urgent need for policies that respect human rights and guarantee decent conditions inside prisons, as well as coordinated State intervention to implement effective and lasting changes.
