La compra pública es un pilar fundamental de la economía de nuestro país, representa cerca del 13% del PIB en Colombia (Observatorio Colombiano de Contratación Pública [OCCP], 2018), por tal motivo, el estado debe procurar que la contratación estatal cumpla con los principios de la función administrativa, garantizando la provisión oportuna de bienes y servicios que respondan a las necesidades de la comunidad en general. En este sentido, el Gobierno Nacional consideró necesario contar con un organismo técnico especializado encargado de unificar las políticas y articular los procesos en materia de contratación pública, con el fin de incrementar la transparencia y optimizar el uso de los recursos públicos; por estas razones, mediante el Decreto 4170 de 2011 se crea la Unidad Administrativa Especial denominada Agencia Nacional de Contratación Pública –Colombia Compra Eficiente. En este escrito daremos un breve recorrido por los objetivos de Colombia Compra Eficiente, conoceremos sus herramientas y pronunciamientos, abordaremos el carácter vinculante de los mismos y descubriremos si la creación de esta Unidad Administrativa Especial ha sido útil a los fines del Estado Colombiano en el marco de los Principios de la Función Administrativa.
