Abstract

Las normas que establecen los límites en la responsabilidad, en Contratos de Compraventa Internacional de Mercancías, se aplican, en el derecho positivo nacional, a partir de los artículos 981 y siguientes del Código de Comercio, en la medida que, define los factores por los cuales se responsabiliza contractualmente a las partes; los convenios internacionales en que, las Reglas de La Haya, La Haya-Visby y Hamburgo, devienen en tratar los límites de la responsabilidad contractual de las partes, por el incumplimiento en la entrega de la carga, la imperfecta ejecución o, en el cumplimiento tardío de sus obligaciones. Al tiempo de tales restricciones normativas, el derecho internacional privado, también ha definido las circunstancias en que opera la exclusión de la invocación de la fuerza mayor, como causal de exoneración de responsabilidad a la parte incumplida, al momento de reclamar por un incumplimiento que por ser previsible, pueda evitarse o superarse, so pena de entrar a compensar, cuando se trata de aplicarle el total de las cláusulas contractuales que regulan la materia, así como las indemnizaciones que a ello haya lugar. Las aseguradoras deberán, estimar la revisión del contrato de seguro, en lo que respecta a los riesgos previsibles, por los incumplimientos causados a partir de la crisis de contenedores de 2020 – 2021, generada por las medidas de confinamiento por Covid -19.

The rules that establish the limits of liability, with respect to contracts for the international sale of goods, find their application in national positive law, starting from articles 981 et seq. of the Commercial Code, to the extent that they define the factors for which the parties are contractually responsible. Likewise, there are international conventions in which the Hage, Hage – Visby and Hamburg Rules deal with the limits of the contractual liability of the parties, for failure to deliver the cargo, imperfect execution or, in late compliance with its obligations. At the time of such normative restrictions, private international law has also defined the circumstances in which the exclusion of the invocation of force majeure operates, as a cause of exoneration of responsibility to the non-compliant party, when claiming for a non-compliance that by be foreseeable, can be avoided or exceeded, under penalty of compensating, when it comes to applying the total of the contractual clauses that regulate the matter, as well as the compensation that may be applicable. Thus, insurers must consider the review of the insurance contract, with regard to foreseeable risks, such as non-compliance caused by the container crisis of 2020-2021, generated at some point by the measures. of confinement due to Covid -19.
