La oposición de buena fe exenta de culpa en los procesos de restitución de tierras: una revisión a partir de los fallos del Magdalena Medio durante el periodo 2018-2020

Abstract

La génesis de los procesos de restitución de tierras se ha fundamentado en brindar un escenario de atención, asistencia y reparación integral a las víctimas del conflicto armado a partir de la creación de unas medidas judiciales, administrativas, sociales y económicas en procura de salvaguardar a las víctimas como sujetos de especial protección por parte del Estado colombiano y de la sociedad. Por consiguiente, mediante el presente trabajo de investigación titulado: “La oposición de buena fe exenta de culpa en los procesos de restitución de tierras: una revisión a partir de los fallos del Magdalena Medio durante el periodo 2018-2020” se ha realizado un estudio detallado de los fundamentos fácticos y jurídicos que se han desarrollado y aplicado por vía jurisprudencial para el reconocimiento de la buena fe exenta de culpa, y además de ello que las víctimas puedan acceder al reconocimiento de la respectiva reparación patrimonial para cada caso en específico, y finalmente, también se destaca la propuesta de unas recomendaciones para la comunidad académica y jurídica sobre los lineamientos que se deben cumplir en concordancia con el ordenamiento jurídico colombiano.

The genesis of the land restitution processes has been based on providing a scenario of care, assistance and comprehensive reparation to the victims of the armed conflict based on the creation of judicial, administrative, social and economic measures in an attempt to provide protection to the victims of the armed conflict as subjects of special protection by the Colombian State and society. Therefore, through the present research work entitled: "the opposition in good faith exempt from guilt in the land restitution processes: a review based on the rulings of the Magdalena Medio during the period 2018-2020" a study has been carried out detail of the factual and legal foundations that have been developed and applied by jurisprudence for the recognition of good faith free of guilt and in addition to this that the victims can access the recognition of the respective patrimonial reparation for each specific case, and finally , also highlights the proposal of some recommendations for the academic and legal community on the guidelines that must be met in accordance with the Colombian legal system
