Alcance de las Garantías del Derecho a la Vivienda de los Segundos Ocupantes en el Proceso de Restitución de Tierras en Colombia

Abstract

Mediante la presente investigación cualitativa se busca analizar las garantías al derecho a la vivienda de los segundos ocupantes en el proceso de restitución de tierras en Colombia y su alcance, conforme a la legislación vigente, tratados internacionales, las observaciones generales del Comité de Derechos Económicos, Sociales y Culturales, la jurisprudencia de la Corte Constitucional, doctrina, informes del Ministerio Público y centros de estudios. Como resultado de esta investigación determinamos que existen un conjunto de garantías al derecho a la vivienda de los segundos ocupantes que deben ser tenidas en cuenta al interior de los procesos de restitución de tierras en Colombia, sin que las mismas puedan retrasar innecesariamente ni suspender indefinidamente la entrega de los predios restituidos en favor de las víctimas.

This qualitative research aims to analyze the guarantees of the right to housing for second occupants in the process of land restitution in Colombia and its scope, in accordance with current legislation, international treaties, general comments of the Committee on Economic, Social, and Cultural Rights, jurisprudence of the Constitutional Court, doctrine, reports from the Public Ministry, and study centers. As a result of this research, we determined that there are a set of guarantees for the right to housing of second occupants that must be considered within the land restitution processes in Colombia, without unnecessarily delaying or indefinitely suspending the delivery of the restituted properties in favor of the victims.
