Justicia Propia en el Pueblo Uitoto Mɨnɨka Post Constitución de 1991

Abstract

This article analyzes the challenges faced by the Uitoto Mɨnɨka People in their ancestral territory within the Predio Putumayo Reserve in the exercise of the Special Indigenous Jurisdiction (hereinafter JEI), starting with the 1991 Political Constitution (hereinafter CP91). To explain ideas and categories that examine how indigenous justice is exercised and how it has developed as a right within the framework of international treaties, laws and jurisprudence that adopt an intercultural perspective, all recognizing ethnic and cultural diversity, considering the intercultural approach. In this way, methodological criteria were established to observe and analyze the challenges posed by the exercise of this right from a descriptive character supported by the ethnographic and case study approach. It is hoped that this research will provide a vision and understanding of the application of justice in a holistic manner, preserving social cohesion in the relationship between the State and indigenous peoples in Colombia.

Este artículo analiza los retos que enfrenta el Pueblo Uitoto Mɨnɨka en su territorio ancestral dentro del Resguardo Predio Putumayo en el ejercicio de la Jurisdicción Especial Indígena (en adelante JEI), a partir de la Constitución Política de 1991 (en adelante CP91). Explicar ideas y categorías que examinen cómo se ejerce la justicia indígena y cómo se ha desarrollado como derecho en el marco de tratados internacionales, leyes y jurisprudencia que adoptan una perspectiva intercultural, todo ello reconociendo la diversidad étnica y cultural, a la luz del enfoque intercultural. De esta manera, se fijaron los criterios metodológicos para observar y analizar los retos que trae el ejercicio de este derecho desde un carácter descriptivo apoyado con en el enfoque etnográfico y del estudio de caso. Se espera que esta investigación aporte una visión y comprensión de la aplicación de justicia de una forma holística preservando la cohesión social en la relación de Estado y pueblos indígenas en Colombia.
