Esta investigación presenta un punto de vista con respecto a la visión que algunos integrantes del Pueblo Arhuaco, tienen de su territorio, concretamente en el resguardo Jimaín; y de paso verificar el cumplimiento de lo consignado en los artículos 13 y 14 de la Parte II. Tierras, del Convenio 169 de la OIT. En este sentido para consolidar la información de nuestra investigación se contó con las siguientes herramientas que permitieron avanzar en nuestro cometido, en primer lugar, se participó en el Diplomado Diálogos Interculturales, y en sus diferentes actividades, así mismo se realizaron entrevistas a los líderes, Saúl Tobías Mindiola Romo, miembro del Pueblo Arhuaco y Concejal del Municipio de Pueblo Bello (César), Herbert Zapata Izquierdo, quien hace parte del equipo de apoyo de las autoridades frente al tema territorial, del resguardo de Jimaín, y Gwaiawingumo Chaparro Torres, miembro del Pueblo Arhuaco. Con estos elementos mencionados, se pasará a construir la visión que éstos líderes tienen sobre su territorio, sus problemáticas respecto a la protección del mismo, teniendo en cuenta los artículos 13 y 14 del Convenio 169 de la OIT y sus derechos como comunidad indígena, también identificaremos el marco normativo y jurisprudencial para explicar los conceptos, características, implicaciones, problemáticas, respecto del territorio indígena.
This research presents a point of view regarding the vision that some members of the Arhuaco People have of their territory, specifically in the Jimaín reservation; and incidentally verify compliance with what is stated in articles 13 and 14 of Part II. Lands, of ILO Convention 169. In this sense, to consolidate the information from our research, we had the following tools that allowed us to advance in our mission: firstly, we participated in the Intercultural Dialogues Diploma, and in its different activities, likewise interviews were conducted with the leaders, Saúl Tobías Mindiola Romo, member of the Arhuaco People and Councilor of the Municipality of Pueblo Bello (César), Herbert Zapata Izquierdo, who is part of the support team of the authorities regarding the territorial issue, of the Jimaín reservation, and Gwaiawingumo Chaparro Torres, member of the Arhuaco people. With these aforementioned elements, the vision that these leaders have about their territory, their problems regarding its protection, taking into account articles 13 and 14 of ILO Convention 169 and their rights as an indigenous community, will also be built.
