Abstract

En el sistema pensional colombiano, existe una proyección de viabilidad y de comportamiento adecuado del sistema, pero ello no viene solamente de un crecimiento en el número de aportantes/contribuyentes, sino también al hecho de que hay un compromiso, de parte del gobierno nacional y, el sistema en general, incluidas las entidades privadas que también reciben y administran los fondos, para adecuarse a los señalamientos que sobre progresividad y ponderación de derechos pensionales han hecho las Altas Cortes colombianas, de manera que, lo que hasta hace unos años podía considerarse como “colegislación”, activismo judicial o intromisión de los jueces en asuntos de exclusiva competencia de las otras ramas del poder público, al presente se ve reflejado en un beneficio del sistema, de los aportantes y de los beneficiarios puesto que no solo se ha conseguido la sostenibilidad fiscal del régimen pensional, sino también la garantía y protección de los derechos de los pensionados en Colombia.

In the Colombian pension system, there is a projection of viability and adequate behavior of the system, but this does not only come from a growth in the number of contributors/contributors, but also from the fact that there is a commitment, on the part of the national government and , the system in general, including the private entities that also receive and manage the funds, to adapt to the statements made by the Colombian High Courts regarding progressivity and weighting of pension rights, so that, what until a few years ago could be considered as "co-legislation", judicial activism or interference by judges in matters of exclusive competence of the other branches of public power, is currently reflected in a benefit to the system, to the contributors and to the beneficiaries since not only has it been achieved the fiscal sustainability of the pension system, but also the guarantee and protection of the rights of pensioners in Colombia.
