La presente investigación pretende establecer si la posibilidad de incurrir en la conducta delictiva de prevaricato por acción por desconocimiento del precedente jurisprudencial por parte de los funcionarios de la judicatura es susceptible o no de afectar el principio de independencia judicial en su connotación individual, entendida esta última, como la que atañe al juez en específico como funcionario independiente incluso de otros miembros del poder judicial, quien debe resolver los conflictos puestos bajo su conocimiento aplicando el Derecho libre de todo incentivo o apremio.
The purpose of this investigation is to establish whether or not the possibility of incurring in the criminal conduct of breach of official duty by action due to ignorance of jurisprudential precedent by judicial officials is likely to affect the principle of individual judicial independence, defined as the one that regards the judge specifically as an independent official even from other members of the judiciary, who must settle the conflicts brought to their attention by applying the law free of any incentive or urgency.
