Con ocasión del aislamiento preventivo obligatorio derivado de la emergencia sanitaria que fue decretada por el Gobierno Colombiano, la mayoría de los servidores públicos del país tuvo que acogerse a un sistema de prestación del servicio absolutamente diferente al ordinario, uno que no es el de la actividad laboral presencial, pero que tampoco encaja dentro del teletrabajo que se encontraba regulado en la Ley 1221 de 2008. Esta eventualidad, que tomó a toda la humanidad por sorpresa, trajo consigo un reto nunca antes visto en la función pública en Colombia: garantizar que todo un país siguiera marchando, sin contar con la atención presencial de sus entidades. Desafortunadamente, este reto además de los aprendizajes y avances que trajo consigo, desencadenó una circunstancia, aunque no mayoritaria si relevante en donde servidores públicos de diversa naturaleza, estuvieron inmersos en eventos asociados al acoso laboral, todo por cuenta de ese entorno laboral novedoso. En el presente documento, se analizará desde el punto de vista jurídico esta circunstancia, sui generi, con la finalidad de determinar los alcances de una eventual responsabilidad disciplinaria, todo por cuenta de una falta de regulación, que solo vino a establecerse con la expedición de la Ley 2088 de 2021.
On the occasion of the mandatory preventive isolation derived from the sanitary emergency that was decreed by the Colombian Government, most of the public servants of the country had to take advantage of a system of service delivery absolutely different from the ordinary one, one that is not that of the face-to-face work activity, but that does not fit either within the teleworking that was regulated in Law 1221 of 2008. This eventuality, which took all mankind by surprise, brought with it a challenge never seen before in the civil service in Colombia: to ensure that an entire country would continue to march, without having the face-to-face attention of its entities. Unfortunately, this challenge, in addition to the learning and progress it brought with it, unleashed a circumstance, although not the majority, it was relevant in which public servants of various kinds were immersed in events associated with workplace harassment, all on account of this new work environment. This document will analyze from a legal point of view this circumstance, sui generi, in order to determine the scope of a possible disciplinary liability, all on account of a lack of regulation, which only came to be established with the issuance of Law 2088 of 2021.
