Abstract

El presente trabajo de investigación emerge de la inquietud de analizar los elementos objetivos de los tipos penales abusivos de la libertad, integridad y formación sexuales, y a partir de ellos identificar en qué casos, no obstante recaer la conducta punible en menores de catorce años, no se lesiona el bien jurídico referido. Para arribar a la resolución del problema jurídico se tuvo que analizar el concepto dogmático de la antijuridicidad, bien como categoría autónoma del delito o como elemento esencial para determinar en qué eventos se lesiona o pone efectivamente en peligro el bien jurídico. Así mismo, nos apoyamos en diversas decisiones proferidas por las Honorables Cortes Constitucional, Suprema de Justicia, Tribunales Superiores de Distrito Judicial y Jueces de la República, al interior de las cuales se estudiaron casos similares como los que nos interesa concluir en los que no se actualizó el concepto de lesividad y que por lo mismo se acudió en la mayoría de ellos a la preclusión de la investigación, lo cual no obsta para que bajo las mismas circunstancias se profiera un sentencia absolutoria en favor del sujeto activo de la acción. Por último, y en lo que concierne a la capacidad del menor para disponer libremente sobre su sexualidad, nos apoyamos en ciencias tales como la sicología y la sociología para fundamentar que no es lo mismo analizar el comportamiento y desarrollo de un menor de edad al momento de construir la norma jurídica que pretende proteger sus intereses y los actuales adolescentes que si bien ostentan una minoría de 14 años, no por ello pueden calificarse automáticamente como incapaces desde la órbita del derecho penal.

The present research work emerges from the concern to analyze the objective elements of the abusive criminal types of sexual freedom, integrity and training, and from them to identify in which cases, despite the relapse of the punishable conduct on minors under fourteen years of age, the aforementioned legal good is not injured. To arrive at the resolution of the legal problem, the dogmatic concept of anti-juridically had to be analyzed, either as an autonomous category of the crime or as an essential element to determine in which events the legal good is injured or effectively endangered. Likewise, we rely on various decisions issued by the Honorable Constitutional Courts, Supreme Courts of Justice, Superior Courts of the Judicial District and Judges of the Republic, within which similar cases were studied such as those that we are interested in concluding in which the concept of harmfulness was not updated and that for the same reason most of them resorted to the preclusion of the investigation, which does not prevent under the same circumstances from issuing an acquittal in favor of the active subject of the action. Finally, and with regard to the ability of minors to freely dispose of their sexuality, we rely on sciences such as psychology and sociology to establish that it is not the same to analyze the behavior and development of a minor when constructing the legal norm that aims to protect their interests and the current adolescents who, although they hold a minority of 14 years, they cannot therefore be automatically classified as incapable from the orbit of criminal law.
