Con la presente investigación se realiza la identificación de antecedentes normativos, jurisprudenciales y teóricos acerca de la vulneración del derecho fundamental a la consulta previa en las comunidades étnicas en Colombia. De igual forma, se analiza el concepto de justicia dentro del marco de las teorías igualitarias aplicadas a la conceptualización de reparación en la actualidad colombiana, y por último se realiza un análisis del caso correspondiente al proyecto de construcción de la represa Urrá sobre el río Sinú, en el departamento de Córdoba, “construcción hidroeléctrica Urrá y un estudio de comparado de jurisprudencia nacional e internacional, a fin de identificar si se da una verdadera reparación integral con ocasión a la vulneración del derecho fundamental a la consulta previa.

This research compiles the normative, jurisprudential and theoretical background about the violation of the fundamental right to prior consultation in ethnic communities in Colombia. In the same way, the concept of justice is analyzed within the framework of egalitarian theories applied to the conceptualization of reparation in Colombia today, and finally an analysis of the case corresponding to the construction project of the Urrá dam on the Sinú river is carried out. , in the department of Córdoba, “Urrá hydroelectric construction and a comparative study of national and international sentences, in order to identify if a true comprehensive reparation is given on the occasion of the violation of the fundamental right to prior consultation.
