Abstract

El objetivo de esta Cartilla es convertirse en una herramienta importante para la investigación y análisis de la jurisprudencia en derecho de autor. Entre sus objetivos específicos se encuentra: 1) Reconocer y analizar qué casos jurisprudenciales han fallado en relación a los derechos patrimoniales, 2) Reconocer y analizar qué casos jurisprudenciales han fallado en relación a los derechos morales, 3) Reconocer el tratamiento otorgado a los diferentes tipos de obra, 4) Reconocer la legitimidad de las sociedades de gestión colectiva, 5) Reconocer el tratamiento dado a algunas excepciones y limitaciones a derecho de autor, 6) Reconocer en qué casos jurisprudenciales se ha dado lugar a una indemnización patrimonial, 7) Reconocer en qué casos se ha dado lugar a una indemnización extrapatrimonial. Por lo tanto, la presente Cartilla facilita al lector o litigante la ubicación de posiciones jurisprudenciales en la materia y la sistematización de la información.

The purpose of this Primer is to become an important tool for research and analysis of copyright jurisprudence. Among its specific objectives are: 1) To recognize and analyze which case law cases have ruled in relation to economic rights, 2) To recognize and analyze which case law cases have ruled in relation to moral rights, 3) To recognize the treatment given to different types of works, 4) To recognize the legitimacy of collective management societies, 5) To recognize the treatment 5) Recognize the treatment given to some exceptions and limitations to copyright, 6) Recognize in which jurisprudential cases a patrimonial indemnity has been granted, 7) Recognize in which cases an extra-patrimonial indemnity has been granted.
