Abstract

La responsabilidad estatal por privación injusta de la libertad es una característica esencial del Estado moderno. Genera un daño objetivo, al vulnerar de los principios fundantes de la filosofía liberal y pilar del nuevo constitucionalismo. Nuestra historia jurisprudencial de reparación, en estos casos concretos, no data de más de medio siglo, con una difícil consolidación, pues lastimosamente en muchas ocasiones el ciudadano puede ser privado de la libertad y absuelto, lo que deviene en futuros procesos, condenas y detrimento patrimonial. En la literatura revisada observamos cuan trabajado y polémico es el tema, en razón al gran número de procesos de este tipo cuyas pretensiones abarcan cifras exorbitantes. Este trabajo indaga sobre la metodología abordada por los jueces en el establecimiento de dos regímenes tan abiertamente disimiles, como el objetivo y el subjetivo. Cuál es su fundamentación jurídica. A lo que se pudo establecer la libre configuración de los jueces en uso del iura novit curia. Una autonomía enraizada en los supuestos fácticos, muy cercana a las corrientes realistas, pero igualmente formalista al convertir el daño por privación injusta de la libertad, en un fenómeno jurídicamente permitido, sometido al principio de legalidad. Es de gran importancia para este trabajo la constitucionalización del derecho, que, a pesar de concebirse desde los principios y valores del constituyente primario, de manera positiva se impone en estas dos grandes ramas involucradas, extremadamente legalistas. Primero para limitar la restricción de derechos y segundo para garantizar la sanción al Estado por el desconocimiento de estos límites.

State liability for unjust deprivation of liberty is an essential characteristic of the modern State. It generates an objective damage, by violating the founding principles of the liberal philosophy and pillar of the new constitutionalism. Our jurisprudential history of reparation, in these specific cases, does not date back more than half a century, with a difficult consolidation, because unfortunately on many occasions the citizen may be deprived of liberty and acquitted, which results in future proceedings, convictions and patrimonial detriment. In the literature reviewed, we observe how laborious and polemic the subject is, due to the large number of processes of this type whose claims include exorbitant amounts. This paper investigates the methodology used by judges in the establishment of two openly dissimilar regimes, the objective and the subjective. What is their legal basis? To which it was possible to establish the free configuration of the judges in use of the iura novit curia. An autonomy rooted in the factual assumptions, very close to the realist currents, but equally formalistic by converting the damage caused by unjust deprivation of liberty into a legally permissible phenomenon, subject to the principle of legality. Of great importance for this work is the constitutionalization of law, which, despite being conceived from the principles and values of the primary constituent, positively imposes itself in these two major branches involved, extremely legalistic. First to limit the restriction of rights and second to guarantee the sanction to the State for the disregard of these limits.
