Abstract

Los usuarios de servicios de salud, pertenecientes al régimen contributivo y subsidiado están amparados por las normas que regulan el Derecho Fundamental a la Salud. Sin embargo, el Estatuto del Consumidor que aplica actualmente a toda clase de servicios, podría proteger a la parte débil en la relación de consumo existente entre los afiliados y los actores del Sistema General de Seguridad Social en Salud, teniendo una aplicación subsidiaria frente a aspectos no regulados en el sector salud. En consecuencia, los afiliados, además de contar con los derechos y mecanismos de protección consagrados en la Ley Estatutaria en Salud, Ley 100 de 1993, Ley 1122 de 2007 y Ley 1438 de 2011, contarían con aquellos que se encuentran previstos en la Ley 1480 de 2011.

Health services users that are part of the subsidized and contributory regime are being protected under the rules that regulate the fundamental right to health. However, the consumer statute that apply in this moment to all kind of services, could protect to the weakest part in the consumers relationship between member & actors in the general System of Social Security in Health, having a subsidiary application towards aspects that are not regulated in the health sector. In consequence, affiliates, other than having their rights & protection mechanisms enshrined in the Statutory Law on Health, Law 100 of 1993, Law 1122 of 2007 and Law 1438 of 2011, They would have those that are provided for in Law 1480 of 2011.
