Esta investigación tiene como objetivo determinar si la interpretación que la Corte Constitucional de Colombia ha dado al derecho al desarrollo tiene fuerza vinculante en el ordenamiento jurídico interno. En lo teórico, la presente se apoya en los fundamentos de la Teoría del “desarrollo humano” del economista Amartya Sen y su complementación realizada por la Filósofa norteamericana Martha Nussbaum. En lo práctico, se indagó en la fuerza vinculante de las sentencias más relevantes de la Corte Constitucional, que hacen referencia al derecho al desarrollo, en las tipologías T (fallos de tutela) y C (fallos de constitucionalidad). Se acude en un inicio a la descripción de su contenido para con posterioridad, analizar los aspectos relacionados con el derecho al desarrollo humano bajo los fundamentos teóricos de la referencia y la forma en la cual dichos postulados cobran fuerza vinculante. Se desarrolló la metodología de análisis jurisprudencial tomando la ratio decidendi de las sentencias proferidas por la Corte Constitucional. Las conclusiones expresan que la hipótesis formulada es “verdadera”, dado que si bien el derecho al desarrollo no está consagrado de forma expresa en la Constitución Política de 1991, su aplicación tiene sustento jurídico y posee fuerza vinculante en las sentencias de la Corte Constitucional que le han dado alcance a través de la fuerza normativa del texto constitucional y la aplicación de instrumentos internacionales de protección de los derechos humanos.

The purpose of this investigation is to determine if the interpretation that the Constitutional Court of Colombia has given to the right to development has binding force in the domestic legal system. Theoretically, the present is based on the foundations of the theory of "human development" of the economist Amartya Sen and its complementation by the American philosopher Martha Nussbaum. In practical terms, the binding force of the most relevant sentences of the Constitutional Court, which refer to the right to development, in typologies T (custody decisions) and C (constitutional decisions) was investigated. Initially, the description of its content is used to analyze the aspects related to the right to human development under the theoretical foundations of the reference and the way in which said postulates acquire binding force. The methodology of jurisprudential analysis was developed taking the ratio decidendi of the sentences pronounced by the Constitutional Court. The conclusions express that the hypothesis formulated is "true", given that although the right to development is not expressly enshrined in the 1991 Political Constitution, its application has legal support and has binding force in the Constitutional Court's judgments. they have reached it through the normative force of the constitutional text and the application of international instruments for the protection of human rights.
