Abstract

En los últimos 10 años la implementación del Fracking como técnica de exploración y explotación de hidrocarburos en yacimientos no convencionales en nuestro país ha estado en el centro de las discusiones de corte ambiental, económico, social y político. No es para menos, puesto que la decisión que se tome desde las instancias gubernamentales, judiciales y legislativas frente a la aplicación o prohibición de esta técnica en Colombia es de la mayor trascendencia bajo el contexto actual del cambio climático y del clamor mundial por la transición hacia las fuentes limpias de energía. Este trabajo de investigación está encaminado a estudiar desde diversas ópticas, pero esencialmente desde el aspecto jurídico, las ventajas y desventajas asociadas a la aplicación del fracking con el objeto de sentar una posición objetiva de cara a su implementación o prohibición en el país.

In the last 10 years the exploration and exploitation of hydrocarbons in unconventional deposits through hydraulic fracturing (“fracking”) in our country has been at the center of environmental, economic, social and political discussions. No wonder, because the decision that is taken from the governmental, judicial and legislative instances regarding the application or prohibition of this technique in Colombia is of great importance under the current context of climate change and the global clamor for renewable energy transition. This research work is aimed at studying from different perspectives, but essentially from the legal aspect, the advantages and disadvantages associated with fracking application in order to establish an objective position about its implementation or prohibition in the country.
