Desde el análisis de las posturas interpretativas del Consejo de Estado al desatar el recurso extraordinario de anulación de laudo arbitral en aquellos eventos en los que sea evidente una causal de nulidad absoluta del contrato, el presente artículo pretende mostrar un ejercicio hermenéutico altamente razonado y razonable que le permite al funcionario judicial invalidar el acuerdo en virtud de la aplicación prevalente del principio del interés general pese a las restricciones propias del escenario judicial que lo convoca.
From the analysis of the interpretative positions of the Council of State when unleashing the extraordinary appeal for annulment of the arbitration award in those events in which an absolute nullity of the contract is evident, this article aims to show a highly reasoned and reasonable hermeneutical exercise that it allows the judicial official to invalidate the agreement by virtue of the prevailing application of the principle of general interest despite the restrictions inherent in the judicial scene that summons it.
