Abstract

La Corte Penal Internacional como máximo Tribunal de Derecho Penal Internacional con carácter permanente, en su ejercicio de investigación y enjuiciamiento de los crímenes de Genocidio, Lesa Humanidad, Agresión y Crímenes de Guerra, ha identificado y compilado a partir del Common Law y Civil Law elementos propios para cada uno de estos crímenes. La sistematicidad, como un elemento contextual que puede evidenciarse sobre ataques contra una población civil, se examina en el contexto de crímenes de Lesa Humanidad y su comprensión puede servir como parámetro para valorar la naturaleza del ataque cometido contra los Defensores/as de Derechos Humanos en asuntos Ambientales, lo que contribuiría a aumentar la respuesta del sistema judicial y la administración justicia como principio constitucional. Palabras clave: Corte Penal Internacional, Lesa Humanidad, Defensores/as de Derechos Humanos en asuntos Ambientales, Sistematicidad.

The International Criminal Court as the highest Court of International Criminal Law on a permanent basis, in its exercise of investigation and prosecution of the crimes of Genocide, Against Humanity, Aggression and War Crimes, has identified and compiled from the Common and Civil Law, elements pertinent to each of these crimes. Systematicity, as a contextual element that can be evidenced about attacks against a civilian population, is examined in the context of crimes against Humanity and its understanding can serve as a parameter to assess the nature of the attack committed against Human Rights Defenders in Environmental matters, which would contribute to increasing the response of the judicial system and the administration of justice as a constitutional principle.
