Abstract

El mundo es cada vez más digital, y en Colombia, no se puede pretender casi que castigar la confianza de los usuarios en los servicios electrónicos. Se requiere, para una correcta gobernanza, y el verdadero cumplimiento de los deberes constitucionales del Estado, una efectiva promoción y vigilancia de este tipo de servicios. Por lo tanto, analizar la manera como están regulados los servicios financieros electrónicos en Colombia, y la manera como la Superintendencia Financiera realiza el seguimiento a los mismos, servirá para establecer en cabeza de quien recae efectivamente la responsabilidad por los daños que se puedan presentar. Ahora bien, no puede trasladarse al Estado la irresponsabilidad o falta de cuidado de los usuarios en el uso de dichas plataformas; sin embargo, la tener una mayor claridad sobre la responsabilidad que compete al Estado, será también más fácil identificar los casos en los que se trata de responsabilidad de las entidades financieras, o de los usuarios, mejorando así las condiciones del sistema.

The world is increasingly digital, and in Colombia, it is almost impossible to pretend to punish the trust of users in electronic services. For proper governance and the true fulfillment of the constitutional duties of the State, an effective promotion and monitoring of this type of services is required. Therefore, analyzing the way in which electronic financial services are regulated in Colombia, and the way in which the Financial Superintendency monitors them, will serve to establish who is effectively responsible for the damages that may occur. However, the irresponsibility or lack of care of the users in the use of said platforms cannot be transferred to the State; However, having greater clarity on the responsibility that falls to the State, it will also be easier to identify the cases in which it is the responsibility of financial institutions, or users, thus improving the conditions of the system.
