Abstract

Las acciones populares tienen dentro de las finalidades establecidas en la ley 472 de 1998. regresar las cosas al estado en que se encontraban antes de la vulneración. Desde la entrada en vigor de la ley 1437 de 2011, que en su artículo 144 estableció la prohibición al Juez de la acción popular de anular contratos, ha cambiado la forma como se venían estudiando las acciones populares, principalmente aquellas relacionadas con la defensa del patrimonio público y la moralidad administrativa. En este estudio se revisa la jurisprudencia del Consejo de Estado, antes de la expedición de la ley 1437 de 2011 y con posterioridad a la misma, y con el análisis de tres casos, se hace una aproximación a medir la efectividad de la incorporación de dicha prohibición en el desarrollo práctico del derecho en el cumplimiento de la finalidad de la acción popular

Popular actions, according to the law 472 of 1998, has the purposes to return things to the state in which they were before the violation. Since the entry into force of Law 1437 of 2011, which in its article 144 established the prohibition to annul contracts by the popular action, changing the way in which popular actions have been studied, mostly those related to the defense of public patrimony and administrative morality. This study reviews the jurisprudence of the Council of State, before the issuance of Law 1437 of 2011 and after it, and with the analysis of three cases, an approach to the effectiveness of the incorporation of said prohibition in the practical development of the law in the compliance of the purpose of the popular action
