Abstract

El presente trabajo busca generar unas reglas de aplicación directa para la responsabilidad del Estado por el hecho del legislador, generando una clasificación de las circunstancias en las cuales puede acaecer esta responsabilidad, es por eso que se realiza una delimitación de las leyes y su control constitucional, de igual manera se aborda las concepciones filosóficas del órgano legislativo, así como las discusiones modernas de los conceptos de daño y perjuicio, de igual manera se abordara los diferentes grados de imputación a tener en cuenta en la responsabilidad del Estado en Colombia, se utilizara como mecanismo de aproximación la jurisprudencia emitida por la Corte Constitucional, en particular en lo que refiere a la cláusula general de la responsabilidad del Estado (artículo 90 de la Constitución política de Colombia), su concepción desde la constitución de 1991 y su desarrollo a lo largo de sus pronunciamientos, de otro lado se revisara la jurisprudencia dada por el Consejo de Estado hasta el momento en lo que respecta al objeto del presente escrito.
