Este estudio se centra en evidenciar las distintas posturas establecidas por los conceptos y jurisprudencia a nivel nacional en materia de transporte público colectivo de pasajeros, pues ha hoy día el estado Colombiano no ha definido cuál es el orden de los requisitos que se deben cumplir para entrar operar, dejando a merced de las alcaldías municipales y distritales o a quienes estas deleguen, la facultad de decidir si deben primero exigir que resulten vencedores del proceso licitatorio que otorgue rutas o en su defecto presentar solicitud de habilitación para ser tenidos en cuenta en futuras licitaciones públicas.

This study focuses on highlighting the different positions established by the concepts and jurisprudence at the national level in the field of public collective passenger transport, since today the Colombian state has not defined which requirements must be met to enter to operate, leaving at the mercy of the municipal and district mayorals or those delegated, the power to decide whether they should first demand that they result from the bidding process that grants routes failing to submit an application for qualification to be taken into account in future public tenders.
