Abstract

Con este artículo se identifican las bases de la responsabilidad del Estado para reparar los perjuicios causados durante el periodo precontractual de un proceso de selección pública, por la no suscripción del contrato estatal cuando está en la obligación de hacerlo. Para esto, se abordan los fundamentos de la responsabilidad precontractual del Estado, haciendo énfasis en la causalidad por omisión, y posteriormente se analizan los títulos de imputación de este tipo de responsabilidad como lo son la buena fe y la confianza legítima, y de esa forma se realizan precisiones frente al deber de reparar los perjuicios generados en esta etapa. Por lo anterior, se hace necesario revisar los antecedentes de la responsabilidad precontractual del Estado, indagando las raíces que se encuentran en el derecho Romano para fijar relaciones de las normas que hoy en día rigen este tipo de responsabilidad.

This article identifies the bases of the liability of the State to repair the damages caused by not signing the statal contract when it is under the obligation to do so in a public selection process. In order to do so, first I describe the foundations of the pre-contractual liability of the State, emphasizing in the causality by omission, and later abording the principles of good faith and legality as titles of imputation of this particular type of responsibility. To develop this idea, I found necessary to review the antecedents of the pre-contractual responsibility, investigating roman law to establish the antecedents some of the laws that govern this type of responsibility.
