Abstract

La práctica jurídico-penal suele confundir el concepto y tratamiento existente en materia de inimputabilidad y su diferencia con la discapacidad, sobre todo la discapacidad psíquica. El presente trabajo de grado identifica los aspectos sustantivos, procedimentales y probatorios necesarios para la comprensión de la discapacidad y la inimputabilidad como fenómenos autónomos en los procesos penales. De la misma manera, se desarrolla a profundidad la salida alterna del principio de oportunidad, sus causales, requisitos, modalidades y requerimientos procedimentales de aplicabilidad y se articula con la discapacidad en el marco del control de convencionalidad.

The legal-criminal practice tends to confuse the concept and existing treatment in matters of unimputability and its difference with disability, especially mental disability. This degree work identifies the substantive, procedural and evidentiary aspects necessary for the understanding of disability and unimputability as autonomous phenomena in criminal proceedings. In the same way, the alternative departure from the principle of opportunity, its causes, requirements, modalities and procedural requirements of applicability is developed in depth and is articulated with disability within the framework of conventionality control.
