Análisis dogmático del patrimonio en Colombia y el cambio de concepto introducido por el procedimiento de insolvencia de la persona natural no comerciante regulado en la Ley 1564 de 2012

Abstract

La Ley 1564 de 2012, es decir, el Código General del Proceso, introduce nuevamente en el ordenamiento jurídico colombiano en su título IV: “La Insolvencia de la Persona Natural no comerciante”; y en la etapa de liquidación patrimonial tanto a la apertura del trámite de liquidación patrimonial, como a la providencia que aprueba la adjudicación, reconoce unos efectos que rompen con el precepto tradicional que establece que el patrimonio del deudor constituye la prenda general de los acreedores. El artículo desarrolla un análisis jurídico de la definición patrimonio en general, de las teorías que existen alrededor, del concepto de patrimonio acogido en Colombia, del cambio de concepto de patrimonio acogido en el ordenamiento jurídico colombiano a partir de la creación del régimen de insolvencia de la persona natural no comerciante, de la evolución del derecho concursal y de insolvencia en Colombia y, finalmente, de las consecuencias del cambio del concepto de patrimonio a partir del procedimiento de insolvencia de la persona natural no comerciante.

The Law 1564 of 2012, that is to say, the General Code of Procedure, introduces again in the Colombian legal system, in its title IV, the process of "Insolvency of the Non-Commercial Natural Person". Also legal institutions as patrimonial liquidation, the opening of the patrimonial liquidation procedure, as well as to the providence that approves the adjudication. Those legal institutions recognizes effects that break with the traditional precept that establishes that the debtor's patrimony constitutes the general pledge of the creditors. The article develops a legal analysis of the definition of patrimony in general, the theories that exist around it, and how it has been established in Colombia. In the same way examines the implied changes in the patrimony concept accepted in the Colombian legal system since the creation of the Insolvency Regime for Non-Business Individuals, the evolution of bankruptcy and insolvency law in Colombia, and finally the consequences of the change in the regime.
