Abstract

En Colombia las universidades públicas de orden departamental y municipal, en virtud de su autonomía universitaria, están facultadas por el Estado para dictar normas y estatutos para llevar a cabo su labor educativa. La autonomía universitaria, se reconfigura desde la teoría institucional del derecho que defiende MACCORMICK, para denominarla autonomía legislativa. Se demostró a través de la metodología de análisis de contenido defendida por KRIPPENDORFF mediante la evaluación del parámetro: relación con la misión académica, magnitudes y escalas y la simulación de una hipótesis consistente en la reproducción de normas contractuales y presupuestales. Sucede lo mismo con la encuesta de percepción aplicada, donde se sostiene que las universidades públicas de orden departamental y municipal , le dan poca o mínima importancia a la autonomía legislativa y por lo tanto, no generan un orden normativo universitario.

In Colombia, the departamental and municipal public universities by virtue of their university autonomy, are empowered by the state to dictate norms and statutes to carry out their educational labor. The university autonomy is reconfigured from the institutional theory of law defended by MACCORMICK, to name it legislative autonomy. It was demonstrated through the content analysis methodology advocated by KRIPPENDORFF through evaluating the relationship of the parameter with the academic mission, magnitudes and scales, and the simulation of a hypothesis consisting on the reproduction of contractual and budgetary norms. Like the perception survey, it is argued that the departamental and municipal public universities give little or minimal importance to legislative autonomy, and therefore, not generating a university regulatory order.
