La responsabilidad del Estado legislador en Colombia como sistema de imputación en materia de responsabilidad administrativa, sigue siendo una expectativa en el desarrollo de la jurisprudencia. A diferencia de países como España y Francia y a pesar de la cláusula de responsabilidad contenida en el artículo 90 constitucional, son contadas las ocasiones en las cuales los jueces colombianos se han ocupado de la responsabilidad estatal por el hecho del legislador. En el presente trabajo se analizaran los principales pronunciamientos del Consejo de Estado y de la Corte Constitucional que constituyen todos los precedentes en la materia.
The responsibility of the legislative State in Colombia like system of imputation as an administrative responsibility, continues being an expectation on the development of jurisprudence. Un like countries such as Spain and France, and despite the responsibility clause contained in constitutional article 90, are counted the occasions in which Colombian judges have dealt with State responsibility for the fact of the legislator. The current work will analyze the main pronouncements of the Council of State and the Constitutional Court that constitute all the precedents on the subject.
