Si se logra constatar que la acción del sujeto que se investiga es adecuada o, en otras palabras, regular, normal y ordinariamente tiene la virtualidad de producir el daño que la víctima padeció, se habrá establecido jurídicamente el nexo de causalidad, no simplemente desde una perspectiva física, sino desde el ámbito jurídico de la adecuación, lo cual permitirá hacerle atribuible a ese sujeto las consecuencias derivadas de su actuar, para luego de ello pasar a hacer el estudio del tercer elemento de la responsabilidad, esto es, el fundamento del deber de reparar con el objetivo de determinar si ese daño padecido por la víctima, que ya se encuentra en relación causa-efecto con la conducta del investigado, desde un punto de vista jurídico y no meramente físico, debe ser resarcido por el sujeto que se considera como autor del mismo

If we achieve to confirm that subject's action that we investigate, is appropiate or, in other words, regular, normal and ordinarily has the virtuality to make the damage that víctim suffered, the causal link will be legally established, not simply from a physics perspective, but from the adequacy legal field, that allows us to assing to that subject the consequences of their actions, and then to make the thrird element of responsability study, that is, the basis of the duty of fix with the objective of determine if that damage suffered by the victim, that is already in relation causeeffect to the investigated conduct, from a legal point of view and not only physical, must be compensated by the subject that is considerated as author of that damage.
