Abstract

El derecho a la visita íntima de las personas privadas de la libertad está considerado por la jurisprudencia de la Corte Constitucional como un derecho fundamental dirigido al fortalecimiento del individuo y su vínculo familiar como mecanismo de resocialización, ya que protege los derechos a la intimidad, libertad sexual, el libre desarrollo de la personalidad, salud y vida familiar durante la detención misma; derecho que puede ser restringido o limitado por las autoridades con fundamento en la previa consagración en normas legales que tienen que ser ejercidas conforme a principios de razonabilidad y proporcionalidad, por cuanto, todas las actuaciones desplegadas por las entidades estatales deberán estar encaminadas a concluir de manera exitosa el fin esencial de la relación Estado – recluso, que consiste en la reintegración a la sociedad de este último. Así mismo, el derecho a la visita íntima de los reclusos debe ser ejercido ajustándose a los principios mencionados, los cuales van dirigidos a mantener el orden y seguridad en los establecimientos penitenciarios; y en ese sentido, se debe garantizar su ejercicio bajo ciertas condiciones. En el presente artículo se analiza el recorrido dinámico de la jurisprudencia constitucional para llegar a la conceptualización del derecho a la visita íntima.

The right to intimate visit of private liberty people is considered by the jurisprudence of the Constitutional Court as a fundamental right aimed at strengthening of individual and their family bond as a mechanism of resocialization, since it protects the right to privacy, sexual freedom, the free development of personality, health and family life during the detention; right that can be restricted or limited by the authorities based on the previous consecration in legal norms that have to be exerted in accordance with the reasonableness principles and proportionality, Therefore, all actions taken by state entities must be aimed at successfully completing the essential purpose of the State - inmate relationship, which consists in the reintegration into society of the inmate. Moreover, the right to intimate of the inmate must to be exerted within the limits of principles mentioned, which are aimed at maintaining order and security in prisons as constitutional purposes, and in that respect, its exercise must be guaranteed under certain conditions. This article analyzes the dynamic path of constitutional jurisprudence to reach at the conceptualization of the right to intimate visit.
