Abstract

Después de más seis décadas de conflicto armado, el Gobierno colombiano decidió instalar unas mesas de dialogo con el grupo FARC-EP, en la habana cuba, luego de diversos obstáculos y de un conflicto bélico que dejaba más víctimas en el país. Se logra llegar al acuerdo final que establecía a través de un tratado entre las dos partes del conflicto el gobierno constitucional del estado colombiano y la guerrilla más antigua del mundo. No obstante este logro sin precedentes para nuestro país estaba sujeto a la aprobación que decidiera el presidente Juan Manuel Santos, el cual en una decisión política decide refrendar los acuerdos a través de un plebiscito por toda la ciudadanía en general, decisión que tuvo un costo político muy alto al ser derrotado en urnas la iniciativa del gobierno al manifestarse en millones de personas en una decisión muy dividida que lo acordado en la Habana, Cuba no satisfacía los intereses de los votantes. Lo cual llevo a la decisión política del ejecutivo de invocar el mecanismo jurídico que previamente había sido creado para la puesta en marcha de los acuerdos el “fast track”, instrumento que permitía en tiempos cortos dar la aprobación de lo acordado entre el gobierno y el grupo beligerante; instrumento que tuvo que ser objeto de control constitucional y que desencadenó la creación de una legislatura que al día de hoy genera críticas y defensas.

After more than six decades of armed conflict, the Colombian government decided to set up a dialogue table with the FARC-EP group in Havana, Cuba, after various obstacles and a war that left more victims in the country. It is possible to reach the final agreement that was established through a treaty between the two parties to the conflict the constitutional government of the Colombian state and the oldest guerrilla in the world. However, this unprecedented achievement for our country was subject to the approval of President Juan Manuel Santos, who in a political decision decided to endorse the agreements through a plebiscite for all citizens in general, a decision that had a political cost very high to be defeated in ballot boxes the initiative of the government to manifest itself in millions of people in a very divided decision that agreed in Havana, Cuba did not satisfy the interests of the voters. Which led to the political decision of the executive to invoke the legal mechanism that had previously been created for the implementation of the agreements the "fast track", an instrument that allowed in short times to give approval of what was agreed between the government and the belligerent group; instrument that had to be object of constitutional control and that triggered the creation of a legislature that today generates criticisms and defenses.
