Abstract

La investigación que se presenta a continuación tiene como fin determinar si las operaciones de bombardeo tipo Beta realizadas por la Fuerza Aérea Colombiana se enmarcan dentro de las normas del Derecho Internacional Humanitario y, en consecuencia, dentro de la teoría del riesgo permitido. El interés por esta investigación está dado por el contexto del conflicto armado interno que vive Colombia desde hace más de cinco décadas, lo que ha implicado la acción de las Fuerzas Militares con el fin de preservar el orden constitucional, a través del desarrollo de operaciones aéreas tipo Beta; se busca determinar si las consecuencias jurídicas de tales acciones se encuadran dentro del riesgo permitido o contrario sensu, constituyen un riesgo jurídicamente desaprobado. Esta problemática exige abordar el estudio de los conceptos de conflicto armado interno, la posición de garante de la FAC y de la teoría del delito, entre otros aspectos. El estudio toma como ejes documentales la doctrina, la ley y la jurisprudencia, por ser estos los componentes esenciales para determinar la legitimidad de las acciones de la FAC.
