Aplicación de la ley 906 de 2004: la desnaturalización del modelo acusatorio.

Abstract

Este artículo explora la manera en que se ha venido desnaturalizando el modelo acusatorio que inspiró la ley 906 de 2004 a causa de la mala práctica y la errada interpretación tanto de legisladores, jueces, fiscales y abogados. La investigación se centra en identificar las falencias que no han permitido que se cumplan los objetivos propuestos en dicha ley, estudiándolos de forma estrecha con la aplicación los principios de acusación, de oralidad e igualdad de armas, para identificar si su práctica es o no coherente con un modelo adversarial. Con base en el derecho comparado y los informes presentados periódicamente por instituciones gubernamentales y no gubernamentales que documentan los avances en la implementación de la nueva ley.

This article search the way in which the adversary proceeding model inspired the law 906 of 2004 and how it has vanished and due to the bad procedures and the wrong interpretation from lawmakers, judges, prosecutors and lawyers. The investigation is focused on the weak points that haven’t permitted to accomplish the achievements in this law. This article studies closely the adversary proceeding principle, the speech, and the equal party opportunity to identify if they are coherent in the practice with the adversary proceeding model. This article takes into account other countries law´s and reports presented by governmental and non-governmental agencies about the advances in the implementation of the new law.
