Resumen: El Consejo de Estado ha adoptado frente a la responsabilidad estatal por privación injusta de la libertad, diversas tesis que datan para este artículo entre los años 1992 a 2019 buscando aplicar el principio de justicia en un orden justo dentro del Estado Social de Derecho Colombiano, e inicia con una responsabilidad subjetiva desciendo poco a poco en una objetiva, que en principio, no observa la conducta que despliega la víctima como generadora del daño, para luego concretarse en que no sólo analiza si el daño es antijurídico o no, sino que le presta vital relevancia al comportamiento de la víctima como causal de exclusión de responsabilidad, la línea jurisprudencial responde a las necesidades jurídicas y económicas de la Nación, al tener en cuenta no sólo a la víctima en sus derechos sino en sus comportamientos generadores del daño y al Estado como parte con derechos y obligaciones. Se reconstruirá una línea jurisprudencial con el fin de identificar el balance y las diferentes tesis sostenidas por dicha Corporación, buscamos resolver el ¿Cuál es el título de imputación aplicable a casos, en los que se reclama la reparación de daños ocasionados por la privación de la libertad de una persona a la que, posteriormente, se le levanta la medida restrictiva?
