Este trabajo se encuentra orientado a determinar si es posible aplicar el acrecimiento en la liquidación del lucro cesante en procesos de responsabilidad civil extracontractual en Colombia, encontrándose como objetivos específicos de mismo, el analizar la figura del acrecimiento como principio general del derecho y su aplicación en Colombia, identificar los criterios que deben tenerse en cuenta en la reparación de los perjuicios en Colombia, y, establecer la forma en que se ha venido efectuando la liquidación del lucro cesante en los procesos de responsabilidad civil y del Estado en Colombia. En consecuencia, la investigación analiza aspectos como los principios generales del derecho, la figura del acrecimiento, los fundamentos de la responsabilidad civil, el lucro cesante en los procesos de responsabilidad civil, la liquidación de este, tanto en la responsabilidad del Estado como en la de los particulares atendiendo las posturas del Consejo de Estado y de la Corte Suprema de Justicia, la aplicación del acrecimiento en la responsabilidad del Estado y los efectos del precedente horizontal. Con sustento en este estudio, se indicará que como se ha hecho en la responsabilidad del Estado al liquidar la indemnización por lucro cesante, en la responsabilidad de los particulares, también resulta viable la inclusión del acrecimiento, por tratarse no solo de una figura propia del derecho privado, sino además, por ser este un principio general del derecho y respetar los criterios fundamentales a tener en cuenta en la reparación de daños, como lo son la equidad, la justifica y la reparación integral.

This work is oriented to determine if it is possible to apply the accretion in the liquidation of the lost profit in tort processes in Colombia, being as specific objectives of it, analyzing the figure of the accretion as a general principle of the law and its application in Colombia, identify the criteria that must be taken into account in the repair of damages in Colombia, and establish the manner in which the liquidation of lost profits has been carried out in the processes of civil responsibility and the State in Colombia. Consequently, the investigation analyzes aspects such as the general principles of law, the figure of the accretion, the foundations of civil liability, the loss of profits in civil liability proceedings, the liquidation of this, both in the responsibility of the State and in the of the individuals attending the positions of the Council of State and the Supreme Court of Justice, the application of the accretion in the responsibility of the State and the effects of the horizontal precedent. With support in this study, it will be indicated that as it has been done in the responsibility of the State when liquidating the indemnification for loss of profit, in the responsibility of the individuals, it is also viable the inclusion of the accretion, as it is not only a figure of the private law, but also, as this is a general principle of law and respect the fundamental criteria to be taken into account in the repair of damages, such as fairness, justification and comprehensive reparation.
