Abstract

Con el desarrollo del constitucionalismo moderno y la protección de los derechos fundamentales entre particulares, resulta plausible plantearse el surgimiento de obligaciones que sin perder su connotación contractual, su origen no está en la autonomía de la voluntad, ni en la ley del contrato, sino en la dogmática constitucional. Para afirmar su recibo dentro de la teoría del derecho, se desarrollan tres aspectos, la estructura de la responsabilidad contractual, el proceso evolutivo del constitucionalismo, la eficacia de los derechos fundamentales en las relaciones entre particulares, y la solidaridad que genera la obligación contractual de cuidado y protección de los derechos fundamentales de la contraparte, permitiendo plantear el surgimiento de una responsabilidad supracontractual.

With the development of modern constitutionalism and the protection of fundamental rights among individuals, it is plausible to consider the emergence of obligations that without losing their contractual connotation, their origin is not in the autonomy of the will, nor in the law of the contract, but in constitutional dogmatics. To affirm its receipt within the theory of law, three aspects are developed, the structure of contractual responsibility, the evolutionary process of constitutionalism, the effectiveness of fundamental rights in relations between individuals, and the solidarity generated by the contractual obligation of care and protection of the fundamental rights of the counterpart, allowing to raise the supracontractual responsibility.
