Incidencia de la Ley 1480 de 2011 en el concepto de servicio público domiciliario

Abstract

En el presente trabajo se tuvo como objetivo principal determinar la incidencia de la ley 1480 de 2011 en el concepto actual de los servicios públicos domiciliarios. Para ello se partió de la contextualización del servicio público de acuerdo a la forma de Estado hasta llegar a la estructura actual del Estado Social de Derecho en Colombia. La metodología utilizada se basó en el estudio de las normas de derecho positivo, lo mismo que en la revisión bibliográfica respectiva. Dentro de las conclusiones planteadas se establece que el carácter de orden público que tiene la ley del consumidor hace que en aras de la protección de los usuarios de los SPD esta tenga prevalencia en algunos aspectos no contemplados en la ley 142 de 1994.

In this work, the main objective was to determine the incidence of Law 1480 of 2011 on the current concept of domiciliary public services. To do this, it started from the contextualization of the public service according to the form of the State until reaching the current structure of the Social State of Law in Colombia. The methodology used was based on the study of positive law norms, as well as the respective bibliographic review. Within the proposed conclusions, it is established that the public order nature of consumer law means that for the protection of users of SPDs, it has a prevalence in some aspects not contemplated in Law 142 of 1994.
