El trabajo describe el derecho marcario desde su fundamentación teórica, fundamentación legislativa internacional a través de la Comunidad Andina – CAN- y, la Organización Mundial de la Propiedad Intelectual – OMPI – , el Protocolo de Madrid y su fundamentación legislativa nacional. En segundo lugar; se desarrollará descriptivamente el régimen jurídico de las mercancías en tránsito aduanero en Colombia vigente en torno a los mecanismos de protección de la marca y por último, se realizan las recomendaciones tendientes a brindar una solución jurídica para lograr efectivamente la protección de la marca.

The work describes the trademark law from its theoretical foundation, international legislative foundation through the Andean Community - CAN -, World Intellectual Property Organization - WIPO -, Madrid Protocol and its national legislative foundation. Secondly; it is about describing the legal regime of the goods in transit in Colombia and the mechanisms of protection of the brand and finally, the recommendations of the information are shown.
