Fraud means misleading someone or deceiving someone by misinforming them about the nature of something. In the meaning of the Turkish Code of Obligations, fraud means achieving execution of a contract by evoking a false impression in the opposing party. A wilful act is required for the fraud to ocur. The subject of this dissertation relates to structure of the concept of fraud in Turkish Law. In the first section we examine concept of fraud as a type defect in will, the conditions required for fraud to occur and the types of fraud. In the second section we expand on effects and consequences of fraud and discuss remediation of damages arising due to fraud. In the third section, we discuss the relations and differences between the concept of fraud and concepts like fault, intimidation, over-enjoyment and comparable, similar concepts which can be defined as types of defect in will.
Hile, bir şey ile ilgili olarak bir kimseyi aldatmak, o şeyin niteliğiyle ilgili olarak yanıltıcı bilgi vererek kandırmak demektir. Türk borçlar hukukundaki hile ise, karşı tarafta yanlış bir kanaat uyandırarak sözleşmenin yapılmasını sağlamaktır. Hilenin oluşması için kasıtlı bir davranış gerekmektedir.Tezimizin konusu Türk Hukuku'nda hile kavramının yapısına ilişkindir. İlk bölümde, irade sakatlığı türlerinden hile kavramı, hilenin oluşması için gerekli şartlar ve hile türleri incelenmiştir. İkinci bölümde, hilenin hüküm ve sonuçları ortaya konulmuş olup, hile sonucunda ortaya çıkacak olan zararın giderilmesi ele alınmıştır. Üçüncü bölümde, hilenin diğer irade sakatlığı hallerinden olan hata, korkutma ile ayrıca aşırı yararlanma ve karıştırılabilecek benzer kavramlardan farkları ve ilişkisi ele alınmıştır.
