Nuove soggettività giuridiche: la tutela delle foreste tra antropocentrismo ed ecocentrismo

Abstract

Il presente contributo intende approfondire la tutela giuridica di alberi e foreste, attraverso una comparazione tra vari ordinamenti e, più in generale, tra l’approccio antropocentrico a quello ecocentrico, approfondendo il tema del riconoscimento della soggettività giuridica della Natura. Dopo una breve premessa dedicata al valore simbolico dell’albero nella storia dell’uomo, lo studio si concentra sulla disciplina giuridica delle foreste in Italia, nell’ordinamento europeo e in America Latina, con particolare attenzione alla sentenza della Corte Suprema colombiana che, nel 2018, ha attribuito alla Foresta Amazzonica la qualità di soggetto giuridico.
