Abstract

Nel 1834, Luigi Ferrarese pubblica il Programma di psicologia medico-forense: un breve ma intenso trattato, ricco di proponimenti, il cui obiettivo è la costituzione di un’ideologia del delinquente ai fini della imputabilità, della graduazione della colpa e della corrispondente pena. L’opera rappresenta il tentativo di guardare ai disordini della mente integrando le prospettive psicologica, morale e penale. Viene così delineata, cinquant’anni prima di Lombroso, la figura dell’uomo delinquente, vale a dire un soggetto sottoposto a forti pressioni psicologiche e sociali, capace di compiere azioni delittuose contrarie, non solo, ad una specifica norma giuridica, ma anche ad una precisa realtà valoriale. Il medico lucano, dopo aver raggiunto grande fama nell’ambiente frenologico europeo, concentra la sua attenzione sulle questioni medico legali, tema che diventerà una costante in tutta la sua vasta produzione letteraria. In un’epoca in cui le disposizioni codicistiche erano impreparate ad interpretare i vari aspetti della diversità umana, in cui le verità certe dello scienziato volevano prendere il sopravvento sulle verità provvisorie dei giudici.
